A Derry man whose car was swaying across the white line and edge markings of a Co Donegal road has appeared in court.
Chris McMonagle was stopped by Gardai along the N13 on December 18 last.
McMonagle, of Ard Grange in Derry, was driving his car at Drean, Manorcunningham when stopped by Gardai.
Letterkenny District Court heard evidence that Gardai had noticed the car was swaying from side to side across the road and the central white line and also crossing the edge markings of the road.
They spoke to the driver and got a strong smell of alcohol from him.
He was arrested and taken to Letterkenny Garda Station but he refused to give a breath sample to Garda Mark Naughton.
A registered nurse was called to take a blood or urine sample but McMonagle also refused this.
His solicitor, Mr Patsy Gallagher, said his client was 37-years-old and had sought assistance for a dependency on alcohol.
The court heard he had a number of previous convictions for drink driving and in 2019 was disqualified from driving for four years.
Mr Gallagher said his client was very frank about the situation and had told him that what he had done was wrong and that “I have to be punished for it.”
Judge Cunningham said she was seeking a Probation and Welfare Report on McMonagle and adjourned the case until May 15th next.
